When do you have to transfer your tax residence to Spain?


More and more people are choosing to move to Spain - whether for work or for a better climate. However, few realize that a prolonged stay in the country may entail the obligation to transfer tax residency. When must this be done and what are the consequences?

Tax residency criteria in Spain

Under Spanish tax law, an individual becomes a tax resident in Spain if he or she meets at least one of the following criteria:

  1. Stays in Spain for more than 183 days in a calendar year - Both full and part days of stay count. Short trips abroad (e.g., vacation) do not break the continuity of stay.
  2. The center of your life and economic interests is in Spain - This means that your main source of income is from Spain, you have a business or significant investments there. Also, having your immediate family (spouse, children) in Spain may mean that you will be considered a tax resident.
  3. You have formally declared tax residency in Spain - You can register yourself with the Spanish tax authority (Agencia Tributaria) if you believe you meet the residency conditions.

Effects of transfer of tax residence

Being a tax resident in Spain means having to account to the Spanish tax for all income earned worldwide, not just in Spain. IRPF (Impuesto sobre la Renta de las Personas Físicas) income tax then applies, with rates that can be as high as 47% for the highest incomes.

It is also worth remembering the double taxation treaty between Poland and Spain. Thanks to it, it is possible to avoid the situation in which the same income is taxed in both countries.

How to avoid automatic tax residency?

If you do not want to be considered a tax resident in Spain, you will need to prove that you have residency in another country, such as Poland. To do so, you may need to obtain a tax residency certificate from the Polish tax office and present it to the Spanish authorities.

Before moving to Spain, it is a good idea to consult a tax advisor to avoid unpleasant tax surprises.
