A Revolution in the Spanish Telecommunications Market: The 400 Prefix Is Now Mandatory for Commercial Calls

News/

Key regulations governing the telemarketing market have come into effect in Spain. In accordance with guidelines published in the Official State Gazette (BOE) and the implementation of the legal framework for consumer protection, companies engaged in telemarketing are strictly required to use numbers beginning with the 400 prefix.

The new regulations represent another step in the fight against persistent telemarketing spam and fraud attempts. Below is a comprehensive summary of the changes, the rights of consumers, and the practical challenges associated with enforcing the law.

Key Principles and Operational Changes for Businesses

The implementation of the new numbering system requires a thorough reorganization of telecommunications systems (VoIP switches, call center dialers) in the Spanish B2C sector. The most important requirements include:

  • Separation of customer service and sales channels: Companies subject to the law may not conduct sales activities using mobile numbers (+34 6xx/7xx), traditional landline numbers (+34 9xx), or toll-free numbers (800/900). These channels are currently reserved exclusively for customer service and post-sale support.
  • Outgoing-only (one-way) numbers: Calls from the 400 range are one-way. A user who receives a call attempt or notices a missed call cannot call back that number. This mechanism is designed to prevent wangiri scams (tricking people into calling back premium-rate numbers).
  • Invalidity of Contracts Entered Into in Violation of the Law: Any commercial contracts entered into during calls initiated from numbers that violate the new regulations or made without the consumer’s prior, express consent are deemed invalid by law.

Consumer Rights and the Process for Reporting Violations

The measures implemented provide consumers with a clear criterion for assessing the nature of a call even before picking up the phone.

  1. Right to Block Prefixes: Any subscriber may request that their telecommunications provider impose a blanket block on all incoming calls from the 400 range.
  2. Illegality of sales attempts from other numbers: Any commercial offer made from a cell phone, landline, or hotline currently constitutes a direct violation of the law.
  3. Official regulatory authorities: Reports of illegal connections may be submitted to three specialized agencies:
  • OAUT (Oficina de Atención al Usuario de Telecomunicaciones) – telecommunications user service offices,
  • CNMC (Comisión Nacional de los Mercados y la Competencia) – the national telecommunications and competition regulator,
  • AEPD (Agencia Española de Protección de Datos) – the Spanish Data Protection Agency.

Verification Tools and the Scale of the Phenomenon

As part of a broader government plan to combat telecommunications fraud (Plan antiestafas), the Spanish Ministry of Digital Transformation has reported that nearly 400 million attempted spam calls and over 32 million suspicious text messages have been blocked to date.

Users in Spain have two official mechanisms for verifying entities that contact them electronically:

ToolApplication
soy-yo.esFree verification of the identity of the company making the phone call.
CNMC Alphanumeric RegistryAn SMS sender lookup tool that verifies the official names of entities sending text messages.

Consumer Organizations' Position: Skepticism Despite Approval

Leading consumer protection organizations in Spain, including OCU (Organización de Consumidores y Usuarios) and FACUA, view the standardization of call identification positively, though they point out gaps in the overall system.

Representatives of the organization emphasize that the regulation will effectively enforce compliance only among entities operating legally and registered in Spain or the European Union. The main problem remains dishonest call centers operating outside the EU’s jurisdiction and cybercriminals using caller ID spoofing (falsifying the number displayed on the phone screen). Until operators eliminate the technical ability to spoof the caller’s identity, consumers will continue to be exposed to illegal telemarketing practices.
